Pedestrian Accidents
Georgia consistently ranks among the deadliest states for people on foot. When a driver strikes a pedestrian, the injuries are severe and the blame is almost always aimed at the person who was walking.
Case overview
A pedestrian has no crumple zone, no airbag and no seatbelt. The same impact that leaves a bumper cracked leaves a person with a fractured pelvis, a traumatic brain injury or a spinal cord injury requiring years of care. Metro Atlanta's wide arterial roads — Buford Highway, Memorial Drive, Cobb Parkway, Roswell Road — were engineered for traffic speed, not for the thousands of people who cross them daily to reach a bus stop, a shift or a storefront.
Almost every pedestrian claim begins with the same accusation: that you darted out, that you were not in a crosswalk, that the driver 'never saw' you. Georgia law is more nuanced than the driver's version. O.C.G.A. § 40-6-91 requires drivers to stop and stay stopped for a pedestrian in a crosswalk on their half of the roadway, and § 40-6-93 imposes a duty on every driver to exercise due care to avoid hitting a pedestrian regardless of where the person is walking — including sounding the horn and taking proper precaution around a child or an obviously confused or impaired person.
Crossing outside a crosswalk is not an automatic bar to recovery. Under Georgia's modified comparative negligence rule (O.C.G.A. § 51-12-33), you may recover as long as you are less than 50% at fault, with your award reduced by your percentage. That single number is what the insurer fights over — and it is won or lost on evidence gathered in the first weeks: signal timing data, crosswalk and lighting conditions, nearby business and doorbell camera footage, event data from the striking vehicle, and the physical evidence of impact and throw distance.
Coverage is the other hard problem. Many drivers who strike pedestrians carry Georgia's minimum $25,000 in bodily injury liability, which rarely covers one ambulance ride and one surgery. Hit-and-run and low-limit cases turn on the pedestrian's own uninsured/underinsured motorist coverage, which in Georgia follows the person — it can apply even though you were walking, not driving — along with resident-relative policies, MedPay and any commercial or delivery policy behind the vehicle.
